Agreement to Terms
By accessing or using Mind Foundry's website, products, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms apply to all visitors, users, and others who access or use the Services. By using the Services, you represent that you are at least 18 years old, or if you are under 18, that you have obtained parental or guardian consent to use the Services.
Description of Services
Mind Foundry provides educational products and services designed for children ages 5-18, including:
Badge-based learning curriculum
Track badges and progress
In-person instruction (where available)

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.
Account Registration
To access certain features of our Services, you may be required to create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.
Product Purchases and Refunds
📖 Workbook Purchases
All workbook purchases are subject to our 60-day satisfaction guarantee. If you are not satisfied with your purchase, you may return it within 60 days for a full refund. Books must be in resalable condition with unused digital codes.
🔑 Digital Access
Book codes provide 6 months of free access to our digital badge tracking platform. Digital access is non-transferable and expires 6 months from activation.
🔄 Subscriptions
If you purchase a subscription service, you may cancel at any time. Refunds for subscriptions are provided on a pro-rata basis for unused time.
Children's Accounts and COPPA Compliance
Mind Foundry is committed to protecting children's privacy. Our Services are designed to be used by children under parental supervision. In compliance with the Children's Online Privacy Protection Act (COPPA):
- Parent or guardian accounts are required to create child profiles
- We collect minimal personal information from children
- Parents may review, modify, or delete their child's information at any time
- We do not condition a child's participation on disclosure of more personal information than reasonably necessary

Intellectual Property
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, images, curriculum materials, and software, are owned by Mind Foundry and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent. However, you may use our educational materials for personal, non-commercial purposes as intended.
Disclaimer of Warranties
Important Notice
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
While we strive to provide high-quality educational content, we make no guarantees about specific educational outcomes. Results may vary based on individual effort, ability, and other factors.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MIND FOUNDRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Franklin County, Ohio.
